Jim Jordan Says House May Soon Pass Bill Targeting Nationwide Injunctions

On Monday, House Judiciary Chairman Jim Jordan (R-OH) said he sees promising signs for a bill that aims to limit federal judges issuing nationwide injunctions after more than a dozen orders blocking various elements of President Donald Trump’s second-term agenda, spurring criticism from Republican lawmakers who argue the rulings are overtly political.

The “No Rogue Rulings Act,” legislation that advanced out of Jordan’s panel with a vote earlier this month, says: “Notwithstanding any other provision of law, no United States district court shall issue any order providing for injunctive relief, except in the case of such an order that is applicable only to limit the actions of a party to the case before such district court with respect to the party seeking injunctive relief from such district court.”

Jordan told Fox News anchor Bill Hemmer that Speaker Mike Johnson (R-LA) has “indicated” that he would like to get the bill to the floor next week. “Hopefully we can get that bill passed next week on the House floor, move it to the Senate, and hopefully get it to the president’s desk,” he added.

An on-screen graphic depicted Harvard Law Review data, showing 15 injunctions have stopped presidential policies during Trump’s second term, which is a little more than two months old. That beats the 14 injunctions during the Biden administration, 12 during the Obama administration, and 6 during the George W. Bush administration. Sixty-four injunctions were levied against presidential policies from Trump’s first-term administration.

Rep. Darrell Issa (R-CA), the lawmaker who introduced the the “No Rogue Rulings Act,” said in a press release: “We have a major malfunction in one part of our federal judiciary: Judges who abuse their power with nationwide injunctions that target President Trump to stop him from advancing the policies the American people elected him to carry out. As of today, these rogue rulings are put on notice and soon should come to an end.”

Democrats lack majorities in Congress, but they have celebrated the judge’s orders as being a saving grace for their side. During a recent “Face the Nation” interview on CBS, House Judiciary Ranking Member Jamie Raskin (D-MD) touted the injunctions and said, “we’re winning across the board.”

House Republicans have unveiled articles of impeachment against several judges they feel are ruling against the Trump administration out of political animus. Trump himself voiced support for impeaching these judges. Last week, Jordan said he would not rule out proceeding with impeachment, however he and other House GOP leaders have not made any commitments.

Jordan also said on Monday there will be hearings focused on federal judges issuing the injunctions. Zeroing in on James Boasberg, an Obama-appointed judge who blocked Trump’s invocation of the Alien Enemies Act to deport alleged members of the Venezuelan gang Tren de Aragua, the chairman declared that “it starts to look like this is getting totally political” when his past involvement in the Russiagate scandal is also taken into consideration.

On another Fox News program, “Sunday Night in America with Trey Gowdy,” Johnson called out “activist judges” issuing injunctions against the Trump administration. “I’m looking forward to working with our good friend Chairman Jim Jordan in the House Judiciary Committee to sort through this and find out what the remedies are to figure out how we can bring correction here because I think it’s important for our system of justice,” he added.

There is movement in the Senate to take legislative action, too, with Sen. Josh Hawley (R-MO) vowing to unveil a bill of his own “to STOP liberal judges’ serial abuse of their power by BANNING nationwide injunctions.”
