Conservative influencer Ashley St. Clair is seeking to legally declare Elon Musk is the father of her child — and get sole custody of her 5-month-old son, according to a pair of petitions she filed in Manhattan Supreme Court Friday.
St. Clair, 26, brought the legal action against the billionaire tech tycoon a week after her bombshell public claims that she gave birth to Musk’s 13th child.
In a paternity petition, which seeks to officially recognize the SpaceX and Tesla boss as the father of her baby, St. Clair claims she and Musk conceived the child during a January 2024 trip to St. Barths.
She asked the court to issue an order requiring Musk, 53, to submit to a genetic test to determine if he is the father.
The X owner has not publicly acknowledged his alleged 13th child.
Included in the court filing is a photo of Musk holding an infant and flirtatious texts the pair allegedly exchanged.
In a separate custody petition, St. Clair claims that Musk was not present for the child’s birth and has only met the baby on three occasions — twice in Manhattan, where she lives, and once in Texas.
Musk has also never asked to see the baby, nor asked for photos of him, the custody filing alleges.
The single mom is seeking sole custody of the child, which is her second son.
In one jarring text exchange in the paternity petition, St. Clair shares a photo of herself and her newborn son in a hospital bed.
“All well?,” replies the recipient who’s saved in her phone as “EM.”
“He is perfect,” St. Clair responds.
“I look forward to seeing you and him this weekend,” EM responds, adding, “Falling asleep. How [sic] the recovery goes well.”
In another exchange, EM laments that he gets “credible death threats everyday.”
To which St. Clair responds: “That’s why the father spot on his birth certificate is blank right now, E.”
She also reasoned that’s why the child bears her last name.
In a separate, flirter text, EM writes, “I want to knock you up again,” after St. Clair sent a picture of herself.
A final text exhibit shows St. Clair sending a large block of text to EM, asking to meet in person due to communication struggles.
“Hmm ok,” EM responds, adding, “Well, I do have a legion of kids to make.”
Musk’s lawyer did not immediately return a request for comment.
The Post has also sought comment from St. Claire’s rep and her child custody attorneys.
Musk shares twins Vivian and Griffin and then triplets Kai, Saxon and Damian, with first wife Justine Wilson.
Pop star Grimes has three children from Musk — boy X, girl Exa Dark Siderael, and boy Techno Mechanicus.
Neuralink executive Shivon Zilis and Musk share another set of twins, Strider and Azure. Zilis seems to be the favorite of Maye Musk, Elon’s mama, who posted an endorsement of the burgeoning little family on X in the wake of the Ashley St. Clair announcement last week.
