New York prosecutors seek September retrial for Weinstein

Prosecutors say they want Harvey Weinstein to face trial again this fall, after an appeals court last week overturned the former Hollywood movie mogul’s 2020 rape conviction.

Weinstein was on-hand in a Manhattan courthouse Wednesday as prosecutors from the Manhattan District Attorney’s Office said they aimed to retry the case against the 72-year-old ex-producer.

“We believe in this case, and we will be retrying this case,” prosecutors said, according to multiple reports. 

Weinstein’s legal team told the court they were “happy” about the request by prosecutors for a speedy trial.

Last week, New York’s highest court overturned his 2020 rape and sexual assault conviction, citing “egregious errors” in the trial. The judge in the original trial, New York’s state Court of Appeals said, allowed women to testify on allegations that were not part of the case. 

Weinstein has denied all charges. 

Prosecutors on Wednesday asked for a new trial after Labor Day in early September. The new date will ultimately be determined by a judge. 

Weinstein will reportedly remain in prison on a separate 2022 rape conviction in Los Angeles. 

The 2017 accusations against Weinstein triggered a flood of public allegations of sexual misconduct against many powerful figures in the entertainment industry, helping to spur the #MeToo and Time’s Up movements.
